The New York Supreme Court upheld a decision by New York State Judge Charles E. Ramos allowing Parker Waichman Alonso LLP to seek disclosure of documents related to a November 2001 Fen-Phen drug case settlement. The settlement had been negotiated by Napoli, Kaiser & Bern, LLP; Parker Waichman had referred hundreds of its clients to Napoli. The current suit alleges that Napoli violated standards of ethical conduct by unfairly distributing the settlement in favor of its own clients.

Ramos’ opinion, delivered last March, was contested by Napoli on the grounds that the Fen-Phen settlement was not of an aggregate nature, and was not subject to the regulations in question.
